  1. Orcoda Limited (ACN: 009 065 650) is the operator of the website www.orcoda.com. This policy sets out the details of how Orcoda collects, stores, uses and discloses your personal information.
  2. Orcoda is bound by the Australian Privacy Principles under the Privacy Act 1988 (Cth) (“APPs”) and is committed to protecting the privacy and security of your personal information. This includes suitable measures to protect electronic information and materials stored and generated in hard copy. Orcoda is also subject to privacy and confidentiality obligations under other laws that govern our activities.

We only collect personal information from you that is necessary to perform our functions, to comply with our legal obligations, and to provide personalised customer service that you have requested. The personal information we collect from you will include information you give us when you register or subscribe to our Website, complete a transaction with us and contact us.
  4. We may collect the following information:

    • your email address;
    • telephone numbers and corresponding names;
    • financial information such as credit card/bank account name and number for processing payments for services provided by Orcoda;
    • records of communications between you and Orcoda relating to services provided by Orcoda;
    • your location as needed for function of the Orcoda mobile application(s)

    • your computer’s browser type and capabilities;
    • your computer’s Internet Protocol (IP) address;
    • usage statistics including: the date and duration of your visit to our website, a list of the web pages that you visit within our site, the time spent on each web page as well as the website through which you linked to our site.

Orcoda ensures that these parties are obliged to protect your personal information from unauthorised access and to only use such information in providing services to us. Orcoda does not send your personal information outside Australia and neither do our current service providers. We also may disclose personal information to your properly authorised representative. Orcoda reserves the right to amend its Privacy Policy at any time and to notify you by posting an updated version on the Orcoda website www.orcoda.com.
  8. You can request to access the personal information we collect and hold about you. When requesting such access please identify the precise type of information requested. If you believe there are errors in the personal information we hold about you, you have a right to ask us to correct it.
  9. We use “cookies” on our site. A cookie is a small data file that is sent from a web server to your browser and stored on your computer. We use cookies to personalise your experience of our website. We do not use cookies to access your computer or to store any personal information. You can choose to accept or decline cookies.     10. Orcoda retains personal information only for as long as reasonably necessary to provide our products and services, manage our relationship with you, comply with our legal obligations, resolve disputes, maintain security, and enforce our agreements.

    If you have an Orcoda account, we retain your account information while your account remains active. If your account is closed, or if you request deletion of your account or personal information, we will delete or de-identify your personal information within a reasonable period, generally within 30 days, unless we are required or permitted to retain it for legal, regulatory, accounting, security, fraud prevention, backup, dispute resolution, or legitimate business purposes.

    Certain records, such as payment, transaction, tax, accounting, audit, legal, and business records, may be retained for up to 7 years, or longer where required by applicable law. Information stored in backups may take longer to remove from all systems, but will be securely protected and deleted or overwritten in the ordinary course of backup management.

    Location data collected through Orcoda mobile applications is retained only for as long as required to provide the relevant app functionality, operational record, service, safety, compliance, or support purpose. When location data is no longer required for these purposes, Orcoda will delete or de-identify it.

    You may request deletion of your personal information, including your Orcoda account and associated data, by emailing us at info@orcoda.com. Please include enough information for us to identify your account and process your request. We may need to verify your identity before acting on a deletion request.

    Where our mobile application provides an in-app account deletion function, you may also request deletion through that function. Deleting your account may prevent you from accessing some or all Orcoda services.

    Orcoda may decline or limit a deletion request where we are legally required or permitted to retain the information, including where retention is necessary for legal, regulatory, security, fraud prevention, dispute resolution, or record-keeping purposes.
